Terms & Conditions

The placement of an order for any services offered by Aquarius Design Solutions and validated by the client’s in any of the following formats - auto signature; printed, signed and faxed; or return email confirmation - constitutes acceptance of the quoted fees and agreement to comply fully with all the Terms and Conditions outlined below. At this time a deposit of 50% for the total job cost to be paid prior to commencement or submission of artwork for production unless alternate arrangements are in place. Work on the project will not commence until Aquarius Design Solutions has received the due amount. All invoices are due for payment 14 day after submission. An interest fee of 10% of the total invoice value will be added (compound) for every 7 days your invoice remains unpaid beyond the due date. You will be issued with a revised invoice at such time that this may occur. Quotes are valid for 30 days only.

Payments

All prices include GST. Payments may be made by cash, cheque, Paypal or electronic funds transfer. Invoices are payable directly on completion of project unless prior payment terms have been set up. Should your account exceed our trading terms and pass to an agency/solicitor for collection, all commissions, solicitor’s fees and any out of pocket expenses will be borne by the Client. Aquarius Design Solutions shall be considered entitled to withhold or remove the customer’s material from any publications, manufacturers & websites, until the amount due has been fully paid. Removal of such materials does not relieve the customer of it’s obligations of payment. All intellectual property rights remain with Aquarius Design Solutions until full payment has been made. Once payment has been made in full, the Client gains 100% rights and ownership of all design work completed. Further changes to any completed or signed off jobs requested by the client or items over and above those listed on the quote, will be charged to the Client on a time basis at of $132 per hour (inc GST).

Data Formats

Images supplied by the Client must be of a quality suitable for use on the design project. Aquarius Design Solutions will not be held responsible for any image quality which the client later deems to be unacceptable. Aquarius Design Solutions cannot be held responsible for the quality of any images which the client wishes to be scanned from printed materials.

Project Duration

Any indication given by Aquarius Design Solutions of a design project’s duration is to be considered by the customer to be an estimation. Estimated project duration should be deemed to be from the date that cleared deposit is received by Aquarius Design Solutions for the initial payment or by a date confirmed in writing. Aquarius Design Solutions will not be held liable for any jobs that are delayed. If a number of design concepts are presented, only one solution is deemed to be given by Aquarius Design Solutions as fulfilling the contract. All other designs remain the property of Aquarius Design Solutions, unless agreed in writing that this arrangement has been changed.

Cancellation or Project Termination

Cancellation of orders may be made via e-mail. If the client cancels the project for any reason, the deposit paid will be forfeited as it is allocated to the time already spent on the project. The deposit is refundable if work has yet to begin. A maximum of 3 rounds of revisions to the concepts provided by Aquarius Design Solutions are included in the initial cost. Additional revisions incur extra cost and will be charged on a per hour basis. If none or no elements of the design concepts are accepted by the Client, Aquarius Design Solutions will offer one additional design concept to try and satisfy the Client’s needs. Additional concepts after this will incur extra cost and deposits in this situation will be forfeited by the Client. Changes, by the Client, to the initial brief after commencement of the project may incur additional costs.

Disclaimer

Aquarius Design Solutions makes no warranties of any kind, express or implied, for any and all products and/or services that it supplies. Aquarius Design Solutions will not be held responsible for any and all damages resulting from products and/or services it supplies. Aquarius Design Solutions is not responsible for any loss, or consequential loss of data, or non-delivery of products or services, of whatever cause. The Client is responsible for archiving any work completed by Aquarius Design Solutions. While we take reasonable steps to investigate the materials we recommend, we accept no responsibility for the performance or quality of materials or any consequential loss arising from their failure. The customer agrees not to hold Aquarius Design Solutions responsible for any such loss or damage. Any claim against Aquarius Design Solutions shall be limited to the relevant fee(s) paid by the customer.

Printing/Publication

Aquarius Design Solutions and its clients agree to comply with Printers Terms and Conditions which include disclaimers for non-completion on time and up to 5% variations in colour reproduction & trimming. The Client is advised to always request a colour proof before any print job commences. Aquarius Design Solutions takes no responsibility on printed colour & quality if the Client uses their own print company. The Client agrees that Aquarius Design Solutions holds no responsibility for any amendments made by any third party, before or after a design is published.

Copyright & Trademarks

By supplying text, images and other data to Aquarius Design Solutions for inclusion in the customer’s website, brochures or other medium, the customer declares that it holds the appropriate copyright and/or trademark permissions. The ownership of such materials will remain with the customer, or rightful copyright or trademark owner. The customer agrees to fully indemnify and hold Aquarius Design Solutions free from harm in any and all claims resulting from the customer in not having obtained all the required copyright, and/or any other necessary permissions.
